As per provisions criminal amendment act, 2003 (Act No. 5 of 2009) and judgment of the Hon’ble Supreme Court of India in Arnesh Kumar Vs State of Bihar & Anr. (Crl. Appeal No. 1277of 2014 (SLP Crl.
